Case Closure and Escheatment of Undistributed Funds: Notice of Custodial Parents and

Non-Custodial Parents with Active Cases. When the Attorney General’s Child Support Enforcement Division

(CSED)has undistributed funds that may need to be escheated and has lost contact with the custodial parent and the non-custodial parent:

(a)The Attorney General shall continue, for at least six

(6)months, to locate the custodial parent or payee whenever money is collected pursuant to an order of support and has yet to be distributed. Such efforts to locate shall be documented by the Attorney General.

(b)Whenever such funds have remained unclaimed for at least five

(5)years, the Attorney General shall begin the process of closing the child support case by sending a closure letter via certified mail to the custodial parent or payee at his or her last known address. The closure letter shall advise the custodial parent that if he or she does not contact the Attorney General within sixty

(60)days, his or her case will be closed and the funds collected under an order for support shall be refunded to the non-custodial parent. If the non-custodial parent cannot be located or no claims have been made by a child or children or surviving heir, the Attorney General shall commence an action for escheatment pursuant to § 34156 of this Article.
