(a)The Commission shall consider the proposed change of zone and may approve or disapprove the same, in whole or in part. The Commission shall make its findings and determination within forty

(40)days from the date of the hearing thereon and shall forward notice of such decision to the applicant, if any. If the application is approved in whole or in part by the Commission, the same shall be forwarded to I Maga’håga/Maga’låhi who may approve or disapprove the proposed change in whole or in part.

(b)Copies of the decision adopted by the Commission and approved by I Maga’håga/Maga’låhi shall be filed in the records of the Department of Land Management’s Office of the Registrar and in the records of the Department of Public Works. Terms and conditions or covenants imposed by the Commission and I Maga’håga/Maga’låhi upon approval of a change of zone shall be covenants that run with the land in perpetuity, whereupon the maintenance of special conditions imposed and compliance with such covenants shall be the responsibility of the property owner. The Director of Land Management shall withhold approval of or endorsement for the issuance of any building permit, certificate of occupancy, or license for use of said property for any failure to conform to the terms and conditions of the change of zone as set by the Commission and I Maga’håga/Maga’låhi.
