Court May Order Old Exhibits Destroyed
View official PDF ↗The court, on its own motion, by an order entered in the minutes, may order destroyed or otherwise disposed or, any exhibit introduced in the trial of a civil action or proceeding which, if appeal has not been taken from the COL120106 DIV. 2 PRINCIPLES OF E VIDENCE CH. 4 WRITINGS decision of the court in the said action or proceeding, remains in the custody of the court three
(3)years after the time for appeal has expired, or, if appeal has been taken, remains in the custody of the court three
(3)years after final determination thereof, provided no such order shall be made authorizing destruction or disposal of any exhibit which conveys title to or creates a lien on real property.
