Guam Procurement Regulations

(a)Regulations. Regulations shall be promulgated by the Policy Office in accordance with the applicable provisions of the Administrative Adjudication Law.

(b)Policy Office Not to Delegate Power to Promulgate Regulations. The Policy Office shall not delegate its power to promulgate regulations.

(c)Regulations Shall Not Change Existing Contract Rights. No regulation shall change any commitment, right or obligation of Guam or of a contractor under a contract in existence on the effective date of such regulation.

(d)Verification and Purchase of Surplus Items. The Policy Office shall establish as part of its regulations that using agencies, including autonomous agencies, obtain written verification from the General Services Agency (GSA), Guam State Agency for Surplus Property, whether items they intend to purchase are available. Written verification shall validate the availability or non-availability of items requested, and shall be provided in a form to be identified or established by the Policy Office. Upon verification by GSA that items are procurable, the using agency may determine whether or not to purchase the items. If GSA has not verified the availability of a particular item within ten

(10)working days, the using agency may proceed with the purchase.
