4 GCA § 14113

Obtaining Relief from Liability

Guam Code AnnotatedTitle 4 — Public Officers and Employees

Relief may be granted if under the following circumstances and conditions:

(a)

(1)an improper certification was based on official records, and

(2)the officer did not know or could not by reasonable diligence and inquiry have discovered that the information was incorrect; or

(b)

(1)the obligation was incurred in good faith, (the officer had no reason to doubt his authority to make the certification);

(2)payment was not prohibited by law;

(3)the government of Guam received some benefit; and

(4)the agency made diligent efforts to collect the debt.
