Statement of Wages Not Paid
View official PDF ↗If an employer cannot or does not pay wages rightfully due when due to one
(1)or more employees, the employer shall, within five
(5)days, exclusive of Saturdays, Sundays, and holidays:
(a)Give each employee and the Director of Labor a statement showing the correct hours worked for the pay period in question, the correct wages earned, the correct legal deductions from pay, and correct wages payable. A statement containing errors shall be considered correct if the employer can establish that the error was an honest error made accidentally and in good faith; and if after ten
(10)working days, the wages have still not been paid, then the employee shall:
(b)Deliver to the Department of Labor a list of receivable due the employer, a list of all the employer's bank accounts along with copies of the latest bank statements, the name of all officers, directors, and managers of the employer if a corporation, and the names, addresses and telephone numbers of any person owning more than ten percent (10%) of the employer, along with copies of all time cards and payment records for all employees for the pay periods missed.
