Effect of Violations on Rights of Action; Attorney's Fees and

Criminal Penalties. If a developer or any other person subject to the provisions of this Chapter violates any provisions thereof or any provision of the project instruments, any person or class of persons adversely affected by the violation has a claim for appropriate relief. Punitive damages may be awarded for a willful violation of this Chapter. The court may also award reasonable attorney's fees. Any developer or any other person subject to this Chapter who offers or disposes of a time-share interval without having complied with this Chapter or who violates any provision of this Chapter shall be guilty of a misdemeanor punishable by a fine not exceeding Five Thousand Dollars ($5,000) or by imprisonment not exceeding one

(1)year, or by both such fine and imprisonment.
