School Lunch/SAE/Child Nutritional Meal Reimbursement Fund

(a)There is hereby created, within the Department of Education (DOE), a special fund called the “School Lunch/SAE/Child Nutritional Meal Reimbursement Fund”, which shall be subject to legislative appropriation. All monies collected by DOE from the school lunch program, Federal Funds paid to the government of Guam for reimbursement under the National School Lunch and Breakfast Programs, and State Administrative Expense

(SAE)Funds shall be deposited into said Fund and shall be administered as follows:

(b)The monies in the Fund shall be used for non-personnel operating expenses in accordance with the guidelines established for such programs.

(c)The Department of Education nutrition program shall be in full compliance with the guidelines set forth by the United States Department of Education and the United States Department of Agriculture.

(d)The School Lunch/SAE/Child Nutritional Meal Reimbursement Fund is excluded from the transfer authority of I Maga’hågan/Maga’låhen Guåhan.

(e)The Superintendent of Education shall submit a separate report of the revenues and expenditures for each of the Fund sources to I Maga’hågan/Maga’låhen Guåhan and I Liheslaturan Guåhan within thirty

(30)days of the close of each quarter of Fiscal Year 2005.
