Powers and Duties of the Joint Board

The Board of Regents of the University of Guam, the District Boards of Education and the Board of Trustees of the Guam Community College shall:

(a)determine if a certificate issued by any state or territory of the United States should be recognized and suffice for issuing a similar certificate to work in the public schools in Guam. The Joint Board shall consider if

(i)a state or territorial certificate was granted with the minimum academic training and other general regulations for the issuance of the same type of certificate on Guam, and

(ii)the laws and regulations of state or territory issuing such certificate provide for similar recognition of certificates issued by the Joint Board;

(b)enter on behalf of the government of Guam and abide by reciprocity agreements on certification of teachers and supervisors, with one or more states or territories of the United States, if the training, experience and other certification requirements of such states or territories are the same COL120106 CH. 16A JOINT EDUCATIONAL BOARD MEETINGS or higher than the requirements for professional certification by the Joint Board in effect at the time of the signing of the agreement.

(c)establish criteria for professional education practices including, but not limited, to the following:

(1)professional performance and continuance in professional services,

(2)teacher certification, and

(3)educational consultants;

(d)provide recommendations to educational institutions or to professional organization of educators which will promote improvement of the education profession but it may not be a party in any labor negotiation or disputes;

(e)adopt, pursuant to the provisions of the Administrative Adjudication Act, such rules and regulations required for performance of its duties not inconsistent with the laws of Guam; and

(f)levy fees for teachers' certificate and renewals in accordance with the regulations of the Joint Board. The fees collected shall be used to defray the administrative expenses of administering a basics skills test to educators.

(g)Funds appropriated to provide loans and professional and technical awards and which are not totally expended may be used in succeeding years so as to increase the number of annual awards. The awards provided in this Chapter are subject to the following limitations:

(1)The applicant must be a bona fide resident of Guam and a United States citizen or a permanent resident alien and must have achieved an overall grade point average of 3.0 or its equivalent in such applicant's undergraduate studies if pursuing an academic graduate degree, or an irrevocable letter of acceptance from an accredited professional school.

(2)the applicant must agree that after completion or termination of the course of studies for which the award was granted, such applicant return to work on Guam for a period of one

(1)year for each Three thousand Dollars ($3,000) received under the award.

(3)The applicant must present to the Board prior to granting of the award satisfactory proof that such applicant has been admitted to COL120106 CH. 16A JOINT EDUCATIONAL BOARD MEETINGS the college or university as a full-time student to pursue a program of study in the field applied for.

(4)The colleges or universities must be properly accredited and must be approved by the Board; provided, however, that no award shall be granted for studies at an off-island institution in a specific academic program that is available at the University of Guam.

(5)The Board shall select the recipients of the awards upon the basis of scholastic ability, financial need, aptitude and health as well as the likelihood of the recipient returning to Guam to fill its professional needs. In determining financial need, the applicant must complete an application form of Federal Student Aid
