Department of Revenue and Taxation Duties; Inspections;

Equipment Requirements; Rule Making.

(a)

(1)The Department of Revenue and Taxation shall conduct inspections of tow trucks to ensure compliance with the Federal Motor Carrier Safety Regulations and the provisions of this chapter.

(2)Each inspection of a tow truck shall be conducted prior to the tow truck beginning operation and at least every quarter thereafter. COL292017 CH. 12 TOW TRUCKS

(A)The Department of Revenue and Taxation shall issue a certificate of inspection for each tow truck that complies with the provisions of this article.

(B)The inspection certificate shall expire one quarter from the month of issuance.

(4)The Department of Revenue and Taxation may charge a fee to cover the cost of the inspection required under this section, subject to the Administrative Adjudication Act,

(b)The Department of Revenue and Taxation shall promulgate rules specifying the equipment required to be carried on each tow truck, including limits on loads that may be moved based on equipment capacity and load weight. The rules shall be adopted in conformance with the Administrative Adjudication Act.
