Requirements

A transfer on death deed:

(a)Except otherwise provided in §3378(b), shall contain the essential elements and formalities of a properly recordable inter vivos deed;

(b)Shall state that the transfer to the beneficiary is to occur at the transferor’s death; and

(c)Shall be notarized and recorded or filed with the Department of Land Management before the transferor’s death.
