Attorney's Fees
View official PDF ↗(a)The attorney for the personal representative shall be allowed out of the estate, as fees for conducting the ordinary probate proceedings, the same amount as is allowed by Section 2803 of this Title as the commission to the personal representative; provided, that if the personal representative is an attorney, and such attorney or any member, employee or shareholder of his law firm, partnership or professional corporation serves as the attorney for the personal representative, then the commission which shall be allowed to the personal representative, combined with the fees which shall be allowed to the attorney for conducting the ordinary probate proceedings, shall be limited to one and one-half
(12)times the amount allowed by Section 2803 of this Title as the commission to the personal representative.
(b)Attorneys for personal representatives shall be allowed out of the estate, in addition to those fees provided in subsection
(a)of this Section, such further amounts as the Superior Court may deem just and reasonable for extraordinary services.
