(10)calendar days after the claim has been filed, or if, when a claim has been presented before filing, the personal representative refuses or neglects to endorse his allowance or rejection for ten

(10)calendar days after the claim has been presented to him, or if the judge of the Superior Court refuses or neglects to endorse his approval or rejection for ten

(10)calendar days after the claim has been presented to him, such refusal or neglect may, at the option of the claimant, be deemed equivalent to a rejection on the tenth calendar day. If the claim is presented by a notary, the certificate of the notary, under seal, shall be prima facie evidence of such presentation and the date thereof. If the claim is filed with the Clerk of the Superior Court or presented to the personal representative before the expiration of the time limited for the filing or presentation of claims, the same is filed or presented in time, though acted upon by the personal representative, and the judge of the Superior Court, after the expiration of such time.
