Claim Founded Upon a Written Instrument; Presentation of

If the claim is founded on a written instrument, the original need not be filed or presented, but a copy thereof with all endorsements must be attached to the claim. The original instrument must be exhibited to the personal representative or to the Superior Court, upon demand, unless it is lost or destroyed, in which case its loss or destruction must be stated in the claim. If the claim or any part thereof is secured by a mortgage or COL120106 CH. 25 PRESENTATION AND PAYMENT OF CLAIMS AGAINST THE ESTATE other lien which has been recorded in the Department of Land Management of the Government of Guam it shall be sufficient to described the mortgage or other lien and refer to the date or volume and page of its record.
