For purposes of this Article and unless the context otherwise requires, Hotel means a building or buildings containing not less than two hundred

(200)guest rooms held out to the public as a place where all transient persons, including but not limited to tourists, who come will be accommodated and entertained as guests for compensation whose facilities are open to the public as a whole; and tourist facility means a building or buildings whose construction cost is not less than Five COL120106 CH. 70 HOTEL DEVELOPMENT Million Dollars ($5,000,000) offering for compensation, sustenance, entertainment, or amusement of tourists, other transients, and other members of the public, the activities of which facility the Board finds beneficial to the development of Guam’s tourist industry.
