Penalties Recoverable by the Commission
View official PDF ↗(a)The Commission, after a hearing conducted after not less than thirty
(30)days= notice, shall have the power to impose upon any telecommunications company which willfully violates any law administered by the Commission or any rule, regulation, or order of the Commission, or which willfully fails, neglects, or refuses to comply with any order after notice thereof, a penalty for each offense not to exceed One Thousand Dollars ($1,000.00), which penalty shall be fixed, imposed and collected by the Commission. Each day that such violation, failure, neglect or refusal continues constitutes a separate offense. Penalties collected by the Commission shall be deposited in the Public Utilities Commission Fund.
(b)Any party aggrieved by a decision of the Commission under this Section may seek review as provided in Section 12119 of this Title.
(c)The Commission may, at its discretion, institute in any court of competent jurisdiction a proceeding for injunctive relief to compel compliance with this Article or any Commission rule, regulation or order.
