Criminal Penalties

(a)Any person who intentionally or knowingly violates this Act is guilty of a third degree felony.

(b)Any physician who intentionally or knowingly performs a partialbirth abortion and thereby kills a human fetus shall be fined not less than Ten Thousand Dollars ($10,000.00) nor more than One-Hundred Thousand Dollars ($100,000.00) under this Title, or imprisoned for not less than one

(1)year nor more than ten
