Required Treatment

(a)No person shall be denied treatment at any designated emergency medical services facility for an emergency medical condition which will deteriorate from a failure to provide such treatment. A hospital, its employees, or any physician or dentist providing emergency medical services shall not be held liable in any action arising out of a refusal to render such treatment if reasonable care is exercised in determining the appropriateness of the facilities, and the qualifications and availability of personnel to render such treatment. (b)No emergency medical services provided by or under contract with the Guam Fire Department and/or Department of Public Health & Social Services Office of EMS shall be denied to any person on the basis of the ability of the person to pay therefore, or because of the lack of prepaid health care coverage or proof of such ability or coverage.
