Procedure After Failure to Comply With Ordered

Evaluation.

(a)If the respondent presents good and credible cause why he or she was not present for an ordered evaluation, the court shall continue the proceeding and issue another order for examination. COL622016 CH. 82A ASSISTED OUTPATIENT TREATMENT

(b)A hearing concerning an individual who fails to comply, without good cause, with a court’s evaluation order shall still proceed.

(c)An individual’s refusal, without good cause, to comply with an evaluation order may be used as evidence of his or her need for treatment and incapability of making an informed medical decision.

(d)If a continuance is ordered, the respondent shall be placed in a designated psychiatric facility and evaluated by a treating professional.

(e)The continuance shall be for no more than seventy-two
