Who May Recommend Conservatorship; Petition by
View official PDF ↗Investigating Officer; Pleading and Filing Requirements for Temporary Conservatorship. When the qualified mental health professional person in charge of a facility providing evaluation or intensive treatment determines that a person in his care is gravely disabled as a result of a mental disorder and is unwilling to accept, or incapable of accepting, treatment voluntarily, he may recommend conservatorship to the officer providing conservatorship investigation. Such recommendation shall be made in a written report supplying pertinent information to include diagnosis, symptoms, prognosis, treatment and reasons for the grave disability. If the officer providing conservatorship investigation concurs with the recommendation, he shall petition the Superior Court to establish conservatorship. Where temporary conservatorship is indicated, the fact shall be alternatively pleaded in the petition.
