Immunity from Liability of Qualified Mental Health

Professional Staff for Action by Person Released Within the Designated Period.

(a)Neither the qualified mental health professional staff of the facility providing intensive treatment, nor the peace officer responsible for the detainment of the person, shall be held civilly or criminally liable for any COL622016 CH. 82 MENTALLY ILL PERSONS action by a person released at or before the end of 28 days pursuant to this Chapter.

(b)If during treatment and evaluation the patient has threatened the life or safety of any other person, it shall be the duty of the qualified mental health professional staff to make a good faith effort to communicate the substance of such threats to the person so threatened prior to the release of the patient.
