Collisions, Accidents and Casualties
View official PDF ↗(a)Duty to render assistance. It shall be the duty of the operator of a vessel involved in a collision, accident or other casualty, so far as he can do so without serious danger to his own vessel, crew and passengers (if any), to render to other persons affected by the collision, accident or other casualty such assistance as may be practicable and as may be necessary in order to save them from or minimize any danger caused by the collision, accident or other casualty, and also to give his name, address and identification of his vessel in writing to any person injured and to the owner of any property damaged in the collision, accident or other casualty.
(b)Accident report required. In the case of a reportable boating accident, the operator of any vessel involved shall file with the Guam Police Department a full description of the accident, including such information as said agency may, by regulation, require. If the operator or owner is incapable of making such report the investigating officer shall submit such report.
(c)Protection of accident reports. Any such report shall be without prejudice, shall be for the information of the Guam Police Department and shall not be open to public inspection. The fact that such report has been made shall be admissible in COL6/5/2019 CH. 69 BOATING evidence solely to show compliance with this Section but no such report nor any part thereof nor any statement contained therein shall be admissible as evidence for any purpose in any trial, civil or criminal.
