Responsibility for Construction, Operation and Maintenance of the Solid Waste The lease-back may require that the contractor be responsible for all costs, expenses and fees of any kind or nature, associated with the improvements, on-site infrastructure, construction, permits and financing associated with the completion of a solid waste facility, except as expressly provided by the lease-back for costs, expenses and fees previously incurred by the government. The lease-back may require that the contractor be responsible for the ongoing operation and maintenance of the solid waste facility during the term of the lease-back.
