Inadequate or Failing Individual Wastewater Disposal System

Any toilet or sewage facility, wastewater disposal system, cesspool, seepage pit, septic tank or privy which fails to comply with the provisions of Chapter 48 of this Title, or which has become dangerous to human life or health, shall be removed, cleaned or emptied by the owner of the premises, as may be ordered by the Director, so as to comply with the provisions of this Chapter 39 and Chapter 48 of this Title. If the owner of such premises does not comply within forty-eight

(48)hours after service of written notice of such order, upon the request of the Director, the work shall be done by the Department of Public Works, using the appropriation of the Department of Public Health and Social Services. The Director of Public Works shall determine a reasonable charge for such work and such amount shall be entered upon the real estate tax duplicate, shall be a lien upon such real estate from the date of entry, and shall be collected in the same manner as real estate taxes.
