Failure to Report

(a)and
(b)of § 2952 to report a case of suspected elderly or adult with a disability abuse who fails to so report shall be liable for a fine of not more than Five Hundred Dollars ($500.00), except that for a second or subsequent offense, such person shall be guilty of a misdemeanor. Fines shall be deposited in the manner prescribed in § 2954(a), infra.
(a)There is hereby created, separate and apart from other funds of the government of Guam, a fund known as the Bureau of Adult Protective Services Fund (Fund). CH. 2 DIVISION OF PUBLIC WELFARE
(b)The Fund shall not be commingled with the General Fund, is exempt from I Maga’håga/Maga’låhi’s transfer authority and shall be kept in a separate bank account, and is not subject to fiscal constraints or limitations, such as a reserve account.
(c)All funds collected shall be expended exclusively for purposes used to support the operations of the Bureau of Adult Protective Services.
