Appointment of Guardian Ad Litem

(a)When a minor, or an insane or incompetent person is a petitioner, he must appear either by general guardian or a Guardian Ad Litem appointed by the Superior Court of Guam. A Guardian Ad Litem may be appointed in a claim for arbitration under this chapter when it is deemed by a judge of the Superior Court of Guam expedient to represent the minor, insane, or incompetent person in the arbitration proceeding, notwithstanding he may have a general guardian and may have appeared by him. The general guardian or Guardian Ad Litem so appearing for an infant, insane or COL120106 CH. 10 MEDICAL M ALPRACTICE – MANDATORY ARBITRATION incompetent person in any arbitration proceeding shall have the power to compromise the same and to agree to any settlement or decision of the arbitrators to be entered therein against his ward, subject to the approval of a majority of the arbitrators.

(b)A Guardian Ad Litem appointed by the Superior Court of Guam to pursue a claim for arbitration shall be appointed pursuant to '373 of the Guam Code of Civil Procedure. Any petition to appoint a Guardian Ad Litem to pursue a claim for arbitration shall have a copy of the demand for arbitration attached thereto.
