Initiation of Arbitration

Arbitration is initiated by a petitioner or petitioners serving a written demand for arbitration upon a respondent or respondents in the same manner provided by law for the service of summons in the Superior Court of Guam; except that the petitioner or his agent may serve the demand without the necessity of it being served by a Marshal of the Superior Court of Guam. The demand for arbitration shall not be filed in the Superior Court of Guam, and arbitration shall not be filed in the Superior Court of Guam, unless the petitioner or petitioners require the appointment of a Guardian Ad Litem, as provided for in § 10113 of this Chapter. The demand for arbitration shall be filed with the Association. The demand for arbitration shall state the name and address of the petitioner or petitioners, identify the respondent or respondents, and shall outline the factual basis of the claim and the alleged acts of negligence or wrongdoing of the respondent or respondents.
