Responsibility of Contractor/Developer

The contract shall require that the contractor/developer be responsible for all costs, expenses, and fees of any kind or nature, associated with the design, civil improvements, on-site and offsite infrastructure, construction, permits, and financing associated with the completion of the Department of Corrections to the extent provided by GEDA in consultation with the Department of Corrections in the Request for Proposal. The lease may, for the purposes herein, provide that its term shall be extended for a period not to exceed the shorter of ten

(10)years beyond the original term of the lease-back, or such period of time as is COL11/30/2021 CH. 90 CORRECTIONS necessary to repay in full any financing arranged pursuant to § 90.309 of this Article.
