Treatment Option for Violation of Act

If an individual is adjudicated guilty of a violation of this Act for which the individual is eligible for probation, the Court may impose a sentence authorized by this Act, may place the individual on probation as authorized by this Section, or may impose a combination of a sentence and probation as authorized by this Section. The Court, with the consent of the individual and with the consent of a treatment facility having inpatient or outpatient programs for the treatment of drug dependent individuals, may place the individual, if found by the Court to be in need of treatment, on probation upon terms and conditions, including participation in a treatment program of the facility. The Court shall order treatment for the period the treatment facility considers necessary. Treatment or a combination of a sentence and probation, including CH. 67 GUAM UNIFORM CONTROLLED SUBSTANCES ACT treatment may not exceed the maximum sentence allowable unless the convicted individual consents to continued treatment. Upon violation of a term or condition, including failure to participate in the treatment program, the Court may revoke the probation and proceed as otherwise provided. Upon fulfillment of the terms and conditions, including attendance and successful completion of the treatment program, the Court shall terminate the probation.
