Creation of Certain Hazards; Oil Pollution by

(a)Except in case of unavoidable accident, collision or stranding, and except as otherwise permitted by law, a person commits a misdemeanor if he discharges or permits the discharge of oil by any methods, means or manner, into or upon the navigable waters of Guam from any vessel using oil for the generation of propulsion power, or any vessel carrying or having oil thereon in excess of that necessary for its lubricating requirements, and such as may be required under the laws of the United States and the government of Guam, and the rules and regulations prescribed thereunder.
(b)As used in this Section, “private place” means a place where one may reasonably expect to be safe from casual or hostile intrusion or surveillance, but does not include a place to which the public or a substantial group thereof has access:
(1)Oil means oil of any kind or in any form, including fuel oil, oil sludge and oil refuse;
(2)Navigable Waters of Guam means all portions of the sea within the territorial jurisdiction of the government of Guam.
