Use of Alcohol and Controlled Substances
View official PDF ↗(a)It is unlawful for a detainee or inmate within a detention or correctional facility operated by the Department of Corrections to use or be under the influence of alcohol or a controlled substance that has not been lawfully prescribed by a licensed healthcare professional.
(b)A detainee or inmate who violates Subsection (a), supra, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a sentence of imprisonment for a period of no less than ninety
(90)days, or by a fine of no less than Five Hundred Dollars ($500.00), or by both. Any sentence of imprisonment for a violation of this Section shall run consecutively to the sentence for which an inmate is being incarcerated.
