Exemptions

(a)The provisions of this Article shall not apply to autonomous agencies as defined by 12 GCA, I Liheslaturan Guåhan, the Judiciary, the Public Defender Service Corporation, the Office of Public Accountability, and the Office of the Attorney General.

(b)Notwithstanding any other provision of this Article to the contrary, except for participation in the compilation and maintenance of an inventory of information technology and technical infrastructure of the government of Guam authorized by § 12.105 of this Article, the provisions of this Article shall not apply to the Guam Department of Education. The Guam Department of Education may cooperate and collaborate with the Chief Technology Officer to the extent feasible. CH. 1 OFFICE OF I MAGA’HÅGA/MAGA’LÅHI [THE GOVERNOR]

(c)I Maga’hågan/Maga’låhen Guåhan may, by executive order, exempt from the provisions of this Article any entity created and organized to facilitate the public and private use of health care information and the use of electronic medical records throughout the government of Guam.
