Intergenerational Day Care Centers
View official PDF ↗(a)The Department shall establish licensing procedures and operational standards for intergenerational care facilities. Facilities seeking licensure must:
(1)Meet all health and safety standards applicable to both child care and adult day care facilities;
(2)Develop and implement intergenerational programming that promotes engagement between children and elderly participants;
(3)Ensure a balanced ratio of childcare and eldercare staff certified in both disciplines; CH. 2 DIVISION OF PUBLIC WELFARE
(4)Maintain separate, age-appropriate spaces while fostering shared activities;
(5)Provide evidence-based programming that supports cognitive, emotional, and social development; and
(6)Develop protocols for the health, nutrition, and emergency care of all participants.
(7)No person convicted of any of the following offenses shall be employed by, volunteer in, or admitted within the daycare facility:
(A)Any sex offense as defined in Chapter 25, of Title 9, Guam Code Annotated and any offense in Chapter 25A of Title 9, Guam Code Annotated;
(B)Any offense of Public Indecency as defined in Article 2 of Chapter 28 of Title 9, Guam Code Annotated;
(C)Any offense of family violence or domestic violence under Chapter 30 of Title 9, Guam Code Annotated;
(D)Any offense of child abuse under Chapter 30 and Chapter 31, of Title 9, Guam Code Annotated;
(E)Any offense involving illegal possession, use, or distribution of controlled substances under Chapter 67 of Title 9, Guam Code Annotated;
(F)Any offense involving the illegal possession, use, or trafficking of firearms or other deadly weapons under Chapter 60 of Title 10, Guam Code Annotated; or
(G)Any equivalent offense in another jurisdiction which contains, at minimum, all elements of the offenses listed above.
(8)Individuals listed on the Sex Offender Registry or any other applicable criminal registry shall be permanently barred from employment, volunteer participation, or enrollment in any capacity at the facility.
(9)Both the adult participant and his/her family shall be interviewed prior to the admission to the Center. The personal interview is to secure pertinent information on the person’s overall behavior and to acquaint the participant and his family with the Center’s policies.
(10)Only those elderly who would benefit and comply with the Center’s care and program should be considered for admission. Persons who may be better served through another existing program should be so informed and referred to the appropriate program.
(b)The Department shall prepare rules and regulations necessary to implement the provisions of this Act, pursuant to (a)(1) of § 9303 of Chapter 9 of Title 5, Guam Code Annotated, within ninety
