Restriction in Use of Local Funds

(a)No funds appropriated from the General Fund of the government of Guam, or any fund where the revenues deposited therein are of local origin, may be used to provide public assistance to any person who is not a U.S. citizen or a permanent resident alien of the United States and registered as such with the United States Immigration and Naturalization Service. For the purposes of this section only, the term “public assistance” is defined as assistance provided through one or more of the following programs administered by the Department of Public Health and Social Services:

(1)General Assistance (as defined in § 2601, 10 GCA) CH. 2 DIVISION OF PUBLIC WELFARE

(2)Aid to Families with Dependent Children

(3)Medically Indigent Program

(4)Medicaid

(b)Funds appropriated from the General Fund, or from other funds collected locally, shall be used in support of the provision of services to individuals who are not U.S. Citizens or permanent resident aliens of the United States, but are citizens of a state in Free Association with the United States, only upon the event that I Maga’hågan/Maga’låhen Guåhan enters into a valid contract with either an instrumentality of the government of the United States or the governments of the Freely Associated States (being the Federated States of Micronesia, the Republic of Palau, and the Republic of the Marshall Islands). The terms of said contract must, at a minimum, establish the immediate reimbursement to Guam of all costs associated with the financial impact of the Compacts of Free Association of the various Freely Associated States listed herein, such impact to be defined and quantified by the government of Guam.
